RIDE MARGATE TOURS/RENTAL TERMS AND CONDITIONS

PLEASE READ CAREFULLY BEFORE BOOKING

To comply with British law and Ride Margate’s Public liability
validation of riders must be obtained, either from the group lead hirer who takes joint full responsibility for their party or from each individual.
Tours and private rental require proof of identification in the form of
PHOTO ID showing proof of ID and ADDRESS eg; Passport or Driving licence.

As the hirer you will be required to provide Credit or Debit card details as a security deposit when hiring/taking Part with Ride Margate. Details will be kept securely for the duration of the rental period and then deleted upon safe return of the bikes and accessories in a satisfactory condition.

If the ebikes and or accessories are not returned or are not in a satisfactory condition Ride Margate reserves the right to charge the hirers Credit or Cebit card with the cost of replacement or repair plus an administration charge of £100.00

WE ADVISE THAT YOU DO NOT RIDE WITHOUT PERSONAL AND THIRD PARTY LIABILITY INSURANCE

Ride Margate does NOT provide insurance for any client or third party.

You agree to accept full responsibility and are advised booking and taking part is entirely at your own risk.

Ride Margate is NOT responsible for any accident, injury or death which may occur either out on the tour or at the meeting premises.
Ride Margate is NOT liable for any loss or damage to any money or property thats results in taking part of the tour.

No booking will be deemed to have been made until Ride Margate has received payment in full. Payment in full is due at the time of booking. Once full payment has been received the client agrees to the following Terms and conditions.

PRICES
Prices are correct at time of publishing, but are subject to change.

CANCELLATION TERMS
A refund* or alternative tour is available with 24 hours notice of cancellation. Where less than 24 hours notice is given then an alternative tour will be offered. Where a booking is made within 24 hours of a tour, no refund will be available on cancellation. However, an alternative tour may be offered.
*Refund. Minus card charges and third party charges.
Ride Margate reserves the right to cancel a tour/Rental where reasonably necessary. In this instance an alternative tour or refund will be available.

Any complaint should be made known verbally to Ride Margate immediately and in writing within ten days of the incident, Ride Margate will endeavour to resolve such complaints to the satisfaction of any aggrieved party. Where no satisfactory resolution is made, a referral may be made to British Cycling for guidance on the final resolution of the dispute.

LATE ARRIVAL
Where a person or group arrives late for a tour, or does not arrive at all, they will forfeit any right to a refund. In this case they may still be eligible for another scheduled tour, at the sole discretion of Ride Margate.


SAFE CYCLING CONDUCT
When signing/booking you agree and are confirming that you accept that cycling has risks and that you (And the rest of your group you are booking for if applicable) are all competent cyclists, and all the riders are over the age of 14yrs of age. It is illegal for an under 14yrs minor to ride an ebike in the UK.

As the hirer you are responsible for all riders in your party and the equipment, you have inspected the bikes and accessories provided and agree that everything is in a satisfactory and safe condition and fit for purpose.

By signing you confirm that you recognise you will be riding an electric bicycle (Ride Margate stocks e-Bike Radrunner 2) which you may not be familiar with and as such you will exercise additional care and attention. You are also confirming that you will listen to your Host safety guidelines on how to safely use the e-Bikes you use on arrival.
You are signing to confirm that you understand the following information.

Safe cycling is dependant on your alertness and good judgement. You are agreeing not to ride if you are in ill-health,have a disability that is likely to affect your ability to cycle, or your eyesight is not up to the standard required for a road driving safety test. You are agreeing not to ride under the influence of strong medication or drugs which may impair your judgement and ability to cycle.
Where a client chooses to consume alcohol during a Tour, they should do so in a responsible manner and in accordance with English law.
On matters of safety during a tour, the decision of the Ride Margate tour guide is final.

You are agreeing to follow The Highway Code a set of information, advice, guides and mandatory rules for road users in the United Kingdom.
The Highway Code applies to all road users including pedestrians, horse riders, cyclists as well as motorcyclists and drivers. The Highway Code is regularly updated to reflect current practices. The 17th Edition (2022) is currently available online Ride Margate strongly advise you are familiar with current set of rules.

FOR EXAMPLE : Recent updates have seen changes, and its important to take note of.

RULE H1.
Sets out the principle that those in charge of vehicles that cause the greatest harm in the event of a collision bear the greatest responsibility to take care and reduce the danger they pose to others.
In essence... Cyclists have a responsibility to reduce danger to pedestrians.

RULE H2.
At a junction cyclists should give way to pedestrians crossing or waiting to cross a road into which (or from which) they are turning.
*Pedestrians have PRIORITY on shared use cycle tracks AND roads unless there are signs to the contrary.
*Pedestrians may use any part of the road
Anyone cycling in a discourteous or unsafe manner While in possession of Ride Margate equipment will have the bikes and accessories repossessed without refund of hire /tour charges.

In following The Highway Code you also agree to NOT ride on pavements, against the traffic or with more than TWO cyclists abreast.
Ride Margate expects you to be courteous to other road users and pedestrians, for example slowing down as you pass and use your bicycle bell to warn pedestrians you are coming. You agree to ride responsibly keeping to the governing speed limit of 15.5mph.

Ride Margate provide helmets for the tour and although it is your personal choice, we strongly advise they be worn for your own safety. Under 18 yrs the wearing of Helmets is Compulsory. Ride margate accepts No responsibility for not wearing of helmets.

You agree to accept full responsibility.

Ride Margate is NOT responsible for any accident, injury or death which may occur either out on the tour or at the meeting premises.
Ride Margate is NOT liable for any loss or damage to any property thats results in taking part of the tour.

You agree to indemnify Ride Margate against any liabilities, costs, expenses, damages and losses arising out of or in connection with death or injury to any person or any damage to property resulting from your involvement in the tour or use of the equipment.

Ride Margate reserves the right not to hire equipment to an individual or group.

Tours and Private rental require proof of identification for the lead hirer Photo ID in the form of passport or driving licence with proof of address.
As the hirer you will be required to provide credit or debit card details as a security deposit when hiring/taking part on a tour with Ride Margate. Details will be kept securely for the hire period and then returned upon safe return of the bikes and accessories in a satisfactory condition. Ride Margate does not store or keep beyond the term of hire any credit card, debit card detail.

If the E-bikes/and or accessories are not returned or are not in a satisfactory condition Ride Margate reserves the right to charge the hirers Credit or Debit card with the cost of replacement or repair.

PAYMENT AND SECURITY DEPOSIT
As the hirer you are fully aware that you will be held financially liable for any loss, theft or damage to all bikes and accessories hired under this agreement (including damage due to excessive dirt and sand) Repairs or replacements will be charged at the full market value of spares, labour, delivery charges and insurance excess fees without the need for authority.
Parts/replacement items supplied from: Radpower bike company supplies and servicing departments.

SAFETY AND SECURITY
As the hirer you are responsible for all riders in your party. You have inspected the bikes and accessories provided and agree that everything is in a safe and satisfactory condition and fit for purpose. As the hirer you recognise everyone in the group to be over 14yrs of age and that it is against the law for an under 14yrs of age to use an E-Bike.
Under 18yrs must be accompanied by an adult, and must wear a helmet.

All bikes are to be ridden safely and responsibly at all times, The e-Bikes will not be used for racing under any circumstances. The e-Bikes will not be ridden on any route which is beyond the level of skill of any party member or on a route unsuitable for the hired bike including the BEACH. Bikes are to be used on roads and designated cycle paths only.

As the hirer you are responsible and agree for all bikes and accessories hired under this agreement and it is your responsibility to keep these items safe from damage, loss or theft. You agree to use them in a proper manner and not subject them to any misuse or unfair wear and tear. All bikes in your party will be locked using the lock provided to an permanent unmovable object through the main frame when not being ridden. You will notify Ride Margate hire immediately of any loss, damage or theft to the hired bikes and /or accessories however caused. As the hirer you acknowledge that if the bikes and/or accessories are damaged or stolen during the hire and this can taken from your credit/debit card without the need for further authority.

NUISANCES
Alcoholic drinks,drugs and Solvent abuse - you or members of your party are NOT permitted to hire or use any bikes or accessories whilst under the influence of drinks, drugs and /or solvents . Failure to comply with the above will result in immediate confiscation of all bikes and accessories. Should this happen you will not be entitled to any refund or compensation and we shall be under no further obligation to you.
